This policy seems overly restrictive. How do you justify the degree of restriction?
This policy is in keeping with regulatory norms. As with other major policy decisions, the Board often consults with other organizations, governments, and Boards of peer or similar planned developments in the area to determine common practices.
We consulted with the Mount Pleasant Police Department, Community Associations Institute, our general counsel, insurance providers and reviewed the covenants and policies of several nearby Mt. Pleasant communities.
We also consulted with the Board of Directors at The Pointe in RiverTowne Country Club as they have a community dock with similar characteristics and challenges. Their dock has been in place as an amenity for over 15 years and serves just over 200 owners. Access to their dock is controlled by a substantial gate with barbed wire “wings” on the walkway. Owners can open the gate with a key and FOB. They also utilize security cameras. Their covenants and restrictions prohibit unaccompanied guests, jumping or diving and require neighborhood stickers watercraft moored at the dock and vehicles parked in the parking lot. They also require that the gate be closed and locked at all times. Permits are required for larger groups of users.
