Why do some people have to pay $15 to enter?

The covenants give the POA the right to charge “tolls” for use of our private roads by commercial vehicles.  Our attorneys define “commercial vehicle” as one entering to provide services or conduct business by a “for profit” entity. This revenue stream currently accounts for more than 10% of the total POA annual income.

According to the covenants, people who are members or guest of the Club are not subject to the toll, nor are guests or contractors entering at the request of a property owner. The Declarant does own property, but does not pay dues on any parcels and, therefore, is not paying money to cover road maintenance through dues. John Wieland Homes agreed that all subcontractors of theirs could be charged, but direct employees (actually paid by the declarant) could enter without charge.  

The POA makes the assumption that a pizza or food delivery to a particular house would presumably call in a pass for home delivery and so food delivery drivers do not pay as it would simply be added to the bill. Dunes West also does not charge government agencies – US Mail, Waterworks, police, fire, ambulance, and the like.
